Day 109 - 28 Mar 95 - Page 26
where -----

MR. JUSTICE BELL: Let us look. They seem to vary in their
precise terminology, though they cover the same ground, but
let us look at one of them so we have it in front of us.

MR. MORRIS: Yes, it was the RSPCA one because it had more
definition than the Farm Animal Welfare Council one.

MR. JUSTICE BELL: Can we find it?

MR. MORRIS: I think it is the Plaintiff's document; it was when
Mr. Bowes was giving evidence, I believe.

MR. JUSTICE BELL: We can either find it there or in
Dr. Pattison's presentation re. the quality control .....

MR. RAMPTON: My Lord, if Mr. Morris wants to know where the
RSPCA Freedom Foods document is, it is behind Mr. Bowes'
statement which is in yellow IX, tab 7.

MR. JUSTICE BELL: Do you have that? Do you have the actual
page?
A. Yes.

Q. The fourth sheet of the Freedom Food?
A. In the Foreword, is that the Foreword?

MR. MORRIS: Yes. You see those Five Freedoms? If we just go
through them one by one -- I am doing this from memory --
but bearing in mind what you have said about -----

MR. JUSTICE BELL: Why not just ask, Mr. Morris?

MR. MORRIS: In terms of let us just look at battery chickens
first: Freedom from hunger and thirst by ready access to
fresh water and diet to maintain full health and vigour.
On that, how does the battery chicken at Sun Valley score?
A. Not -----

MR. RAMPTON: There are no battery chickens at Sun Valley.

MR. MORRIS: Sorry, oasters, sorry.
A. Well, if you kept a free range hen with water and
layers' meal, it could be kept in full health and vigour,
but in a battery cage it will not be in full health and
vigour because brittle bones are almost inevitable in the
battery cage system, so I would think that was not
applicable to -----

MR. JUSTICE BELL: Yes, it is related to ready access to fresh
water and diet, is it not?

MR. MORRIS: Yes.

MR. JUSTICE BELL: I think you have really to ask yourself,
Mr. Morris, whether you are just approaching, you know,
deciding to plough the field from another direction, or
ploughing a new field altogether.
