     1   MR. JUSTICE BELL:  I think that is the difficulty.

     3   MR. RAMPTON:  That, your Lordship, was the difficulty.

     5   MR. JUSTICE BELL:  We withdrew Dr. Pattison about it ----

     7   THE WITNESS:  But I did speak to Dr. Potter, who is the head of
     8        the Farm Animals Department, on Friday ----

    10   MR. JUSTICE BELL:  I am sorry, I have not stopped you saying on
    11        a large number of occasions what people have told you.
    12        I will actually have to ignore it when I come to make a
    13        decision because it is hearsay evidence and not admissible.

    15   THE WITNESS:  I wanted to say that he was happy for me to talk
    16        generally, but I did not feel ----

    18   MR. JUSTICE BELL:  I would have thought -- correct me if I am
    19        wrong -- that some people might be a little disconcerted if
    20        either you or Dr. Pattison produced a copy to support your
    21        evidence one way or another.  It was because I think people
    22        appreciated that that Dr. Pattison was impressed about it.

    24        I think it is highly unlikely that its contents will, at
    25        the end of the day, decide the matter one way or another in
    26        my mind, with the abundance of evidence we have.  Unless it
    27        is absolutely vital to produce it, I would rather leave it
    28        there and, therefore, have no further comment on it because
    29        that is but another way of saying what it says.

    31   MS. STEEL:  Is it possible, without going into any detail
    32        whatsoever, just to say whether that would be the only
    33        aspect in which a typical broiler farm would not?

    35   MR. JUSTICE BELL:  I would rather leave it at this:
    36        Dr. Pattison has expressed a view that they could come
    37        within the recommendations, if I remember his evidence
    38        correctly.  That was the way it was rather left, and you
    39        would say, no, that is not so?
    40        A.  Yes.

    42   Q.   I think it is going to be of limited effect to my final
    43        decision to consider whether in or about 1989 or 1990 what
    44        I make of the practices as they were at Sun Valley, or
    45        likely to be, to look at what FAWK is recommending in
    46        1995.  You are not to read anything into that either for or
    47        against your case.  It is just a statement for your
    48        approach.

    52   MR. JUSTICE BELL:  No, the present suggestions, which are but in 
    53        draft and sent to Dr. Pattison and sent to you, as
    54        I understand it, as part of a consultation process?
