Day 109 - 28 Mar 95 - Page 09

MR. MORRIS: That is paragraph 36.
       A. Yes. I was surprised when we learned that cull pens
were put for turkey but, perhaps, we are not discussing
       turkeys now because this -----

MR. JUSTICE BELL: No, at the end of the day, this case is about
the leaflet and, for better or worse, I have ruled that
turkeys are out so far as that is concerned.
       A. Yes.

MS. STEEL: But, in terms of transporting, for example, if a
bird received a crushed head -----
       A. Obviously, that would be completely contrary to any
law, code or advice, yes, completely.

  Q. If that happened on catching at farms?
       A. Yes, it should, but it should be -- it should never
happen and a bird should be culled if it did happen at the
loading point, yes, the catching point.

  Q. I do not know if you see there is anything on transport I
       have not asked about?
       A. No, I do not think so.

  Q. Going on to slaughter, do you have any comment to make on
the omission from both Dr. Gregory's and Dr. Pattison's
statement of the time span between stun and neck cut, the
neck cutting stall, and also the stunning current that was
       used?
       A. Yes, I was frankly surprised by the whole report
because I have always held Dr. Gregory in great -- had
great respect for his research. In fact, I have consulted
him on more than one occasion when preparing our fact
sheets to make quite sure that I have not made any mistakes
or omissions, and he has helped me with that.

I am thinking, for instance, of these two papers,
"The Effect of Slaughter on the Spontaneous and Evoked
activity of the Brain" and "Humane Slaughter", they point
out, really, all the things that were happening at Sun
Valley were contrary to his usual advice. I was surprised
that he was not more hard on the proceedings at Sun Valley
which included very low, well, prestun shocks, as we know,
very low milliamps, a lack of cutting very often one
carotid artery, let alone both, masking sentiency through
cutting the spinal chord and decapitation of birds which
had missed all the correct processes which, contrary to
what people think, does not bring instantaneous brain death
by any means -- 50 seconds I think they are suspected of
being conscious for -- and it seemed to me a catalogue of
all the things that Dr. Gregory recommended against and has
done in many, many published papers, so I was surprised,
       yes.

  Q. In terms of the specific omissions about the time span
between those two, the stun and things like that, are they
factors that are important to know when ---
       A. Yes, because if the ----
