Day 106 - 23 Mar 95 - Page 35

are McKey's Microbiological Guidelines for raw meat. The
       next batch of importance -----

MR. JUSTICE BELL (To the witness): Have you seen that before?
       A. To be frank, my Lord, it is difficult to say. I have
seen that many documents. It looks familiar. It certainly
does not take me much time to absorb the content at all.

  Q. Right, i will put a query against that.

MR. RAMPTON: The next batch, tab 5 of the same bundle, which
are the McKey quality control summaries sent to McDonald's
       for beef and pig.

MR. JUSTICE BELL: Have you seen those?

MR. RAMPTON: Particularly the last few pages which contain
recorded results in summary for a particular week.

MR. JUSTICE BELL: Have you seen those, Mr. North?
       A. I do not recall them, my Lord, but, as I say, it does
not take me much time to absorb the content.

  Q. Maybe, but I would like you to tell us whether you recall
seeing them or not before. So I have put query against
tab 3 and I have put a cross against tab 5. Yes?

MR. RAMPTON: My Lord, perhaps one should have started actually
at tab 1B of this volume because those are the origins of
the matter in this sense, that they are the McDonald's
       specifications, microbiological specifications, for chicken
and beef. I am sorry they are out of order.

MR. JUSTICE BELL: Do you remember seeing those microbiological
       criteria before, those specifications?
       A. I have not seen that, my Lord, but -----

MR. JUSTICE BELL: Do not make any comment on it; just whether
you have seen them or not. I will put a cross against
       that.
       A. I must say, my Lord, my memory is not reliable. I have
       not seen that many documents.

  Q. Very well.

MR. RAMPTON: Then, my Lord, at tab 7C, there has been for a bit
of time now that pair of typewritten sheets, purporting to
show the results of microbiological tests both on raw meat
and on finished product for 12th January 1994, again from
McKey's. That has now been supplemented by documents from
McKey's relating both to January 1992 and January 1994
consisting partly of sheets from the microbiological ledger
and partly from meat receiving reports. Those the
Defendants had, I think, on Monday. I hope your Lordship
       has that?

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: If one moves on to tab 8 one moves to -----
