Day 100 - 09 Mar 95 - Page 31

  Q. It is just I am not sure where this document is.
       Patty -----

MR. JUSTICE BELL: No, please, you must address her as
"Mrs. Brinley-Codd". There are two very good reasons for
that. Firstly, everyone is entitled to say how they should
be addressed. That is just as valid as the second reason,
which is that, for better or worse, you are involved in
litigation and, while courtesy and ability to get on is
paramount, a basic formality of address just helps it to
       run along smoothly.

MR. MORRIS: I have a document I want to show to the witness,
but I cannot remember where it was put.

MR. JUSTICE BELL: I am sure she will help you. I did not mean
to deter you from that. Are you finished with this
       memorandum for the time being?

MR. MORRIS: Yes, I have finished with the memorandum. It is
not very satisfactory -- the document is a reply from
McDonald's to someone in the university of Paisley on
8th March 1993. I have only one page of it because my
system is not the best, but it is the only way I can work
at the moment. It is marked but I have not written on it.
I have just highlighted what I want the witness to see. It
is an extract from a letter which was to the -- because the
students union were having a discussion.

MR. JUSTICE BELL: Has Mr. Rampton seen that?

MR. RAMPTON: My Lord, I have no idea.

MR. JUSTICE BELL: Let Mr. Rampton see it. I had thought if it
was a document you would have seen it if it is in a bundle
somewhere but you just cannot track it down. But let
       Mr. Rampton see it anyway.

MR. RAMPTON: My Lord, it rings no bells with me at all but that
       does not mean anything.

MR. MORRIS: If it can be shown to the witness? It is just
       paragraph 6.

MR. RAMPTON: I saw what it says. I have no objection to it
       proceeding. We must get on.

MR. MORRIS: It is a McDonald's document anyway, a letter.
(To the witness): Just read paragraph 6. Do not concern
       yourself with the whole document.
       A. Yes.

  Q. Just the point I want to say here is that when we were
discussing Preston this morning, the Preston incident, you
said it was not conclusive but in this document McDonald's
is saying: "There has never been any evidence to
demonstrate that McDonald's was the cause of this
       outbreak".

So, they are saying there there was not any evidence at
