Day 100 - 09 Mar 95 - Page 28

MR. JUSTICE BELL: The outstanding documents really relate to
       microbiological testing.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: If you have questions on any other McKey
procedures, apart from microbiological testing, it seems to
me you ought to be able to deal with those before you get
       any further discovery.

If you dealt with them today and when you get documents it
occurs to you that you could have asked, or should have
asked, a further question on it, then we can cope with
that. But you ought to be able to deal with anything else
relating to McKey's but microbiological testing. As
Mr. Rampton said, we had quite a lot on it yesterday
anyway. I do not know that there are other McKey
procedures. Then you have animal welfare. I was going
       to ------

MR. MORRIS: There is also the in-store, in-restaurant matters.

MR. JUSTICE BELL: In so far as Mr. Kenny deals with them
because that was largely Mr. Atherton, was it not?

MR. MORRIS: Yes, but he makes -----

MR. JUSTICE BELL: Mr. Kenny has said he stops at the restaurant
       back door ---

MR. MORRIS: But he has put stuff in his statement.

MR. JUSTICE BELL: -- save for certain checks.

MR. MORRIS: He has mentioned it in his statement.

MR. JUSTICE BELL: Is the truth of the matter that you are just
a bit stuck at the moment?

MR. MORRIS: Yes, it is question of organisation.

MR. JUSTICE BELL: Right. What I think it is probably best to
do, instead of breaking off at five to one and coming back
at quarter past, I will break off now. I will come back at
2 o'clock, or as near to 2 o'clock as I can, and we will
       continue then.

MR. MORRIS: That would be very helpful.

MR. JUSTICE BELL: But I think you should be ready to deal with
non-microbiological testing in McKey's procedures, in so
far as you want to, any other matters and Ms. Steel, if
that is the way you have allocated it, to deal with any
animal welfare matters which Mr. Kenny can sensibly be
asked about. I will come back at 2 o'clock.

                       (Luncheon Adjournment)

MR. MORRIS: Mr. Wignall on page 5 of his statement said that
the recommended cooking times for 10-1 patties and quarter
