     3        A.  It was not -- it was not led by my department actually.
     4          At the time it was led by someone who was closer to the
     5        incident and based in the Birmingham office.  Because of
     6        the speed with which we had to react, it was carried out by
     7        someone who is now -- "Food Safety Officer" is her title.

     9   Q.   Who is that?
    10        A.  A woman by the name of Jill Barnes.

    12   Q.   It is correct, is it not, that the McNuggets were tested by
    13        the local health officials and declared unfit for human
    14        consumption?
    15        A.  I do not know.  I am honestly do not know the details
    16        of the case.

    18   MR. JUSTICE BELL:  Is Ms. Barnes not a witness?

    20   MR. RAMPTON:  Yes, she will be a witness.  My Lord, the only
    21        thing I observe about this at the moment is that I am not
    22        objecting to the cross-examination, whether Mr. Kenny can
    23        help is another question.  This being a very recent
    24        pleading, we have not made any discovery.

    26   MR. JUSTICE BELL:  I appreciate that.  It may be there is an
    27        admission, I do not know.

    29   MR. RAMPTON:  It may be admitted, I do not know, in terms.  The
    30        Defendants perhaps had better wait and see.

    32   MS. STEEL:  This was again an incident where there had been
    33        confusion over timing devices; is that right?
    34        A.  As I say, have not been involved in the investigation.
    35        I am sorry, I cannot answer.

    37   MR. JUSTICE BELL:  Can you help us at all about the
    38        circumstances surrounding that?
    39        A.  I know very little of the case, only the fact that
    40        there was an under-cooking problem.

    42   MR. MORRIS:  There is one question -- I cannot remember where
    43        I read it now -- you make use of some laboratory in Germany
    44        for independent microbiological testing; is that correct?
    45        A.  We have a McDonald's laboratory in Frankfurt which is
    46        mainly used for -- it is not used for microbiological
    47        testing, no; it is used for sensory testing and for
    48        specification, physical compliance testing.

    50   Q.   I read that somewhere.

    52   MR. JUSTICE BELL:  I think that was on another line altogether.

    54   MR. MORRIS:  I want to leave the McKey's until we get the
    55        documents, really.

    57   MR. JUSTICE BELL:  Yes.  If there is any discrete part in
    58        relation to McKey's which does not involve documentation
    59        which may be forthcoming, deal with it.  Quite frankly, one
    60        approach you could have to that is to wait and see what
