Day 097 - 06 Mar 95 - Page 10

MR. JUSTICE BELL: Why do you not leave that there? I have
asked Mr. Rampton to look at it. I would have thought on
what I know about the matter that Mr. Beavers should be
       completed, cross-examination and re-examination, within
three days. On the other hand, I realise that he is as
near as one is going to have as a McDonald's witness in
this case to being the US equivalent of Mr. Preston in this
       country.

I do see a benefit in him coming to start evidence on a
Monday in a full week. But there we are. I am not going
to say any more about that now. I have asked Mr. Rampton
if he would enquire into it further. I will hear what he
       says in due course.

Can we just pick up the -----

MR. MORRIS: Our own witnesses, shall I move on to those?

MR. JUSTICE BELL: Look, the first step is this, allowing for a
little bit of possible slippage over Mr. Chambers,
Mr. Kenny, Mr. Pattison returning and Mr. Bennett, you are
hopeful, are you, Mr. Morris -- Ms. Steel, if you want to
say anything, please do but I will address Mr. Morris for
the time being -- that we will finish those witnesses
Mr. Chambers, Mr. Kenny, Mr. Pattison and Mr. Bennett by
       the end of next week?

MR. MORRIS: We are hopeful. We are a little bit concerned
about Mr. Kenny only being -----

MR. JUSTICE BELL: He has a maximum of three days, he may be a
       little less.

MR. MORRIS: He may be a little less than that because of this
       morning.

MR. JUSTICE BELL: I see. You have left two days for over-run
of one kind or another. I see your schedule. So, what you
are really saying, your estimate is that your witnesses can
really be expected to virtually fill the time up to Friday,
       7th?

MR. MORRIS: Yes. Can I just point out that we have a witness
who has not done a statement yet who is actually a person
that worked at Sun Valley as a catcher from the broiler
houses. We are trying to get a quick statement done from
him. I do not want to say -- we are in chambers -- I do
not believe he can actually write himself, so we are having
to work out a way of taking the statement from him in the
light of what Mr. Pattison was saying.

We are trying to get that completed obviously before
Mr. Pattison gives evidence. That should not take too
long. That will probably be a day at the end of that
time. I do not want to give his name out at this stage.

MR. JUSTICE BELL: But the purpose of a statement, if it is
signed, it may be thought that it carries with it some
