Day 092 - 27 Feb 95 - Page 22

       witness.

MR. JUSTICE BELL: Can you identify what the document is?

MS. STEEL: It is from -----

MR. JUSTICE BELL: It is some regulations, is it not?

MS. STEEL: Yes, the Code of the Laws of the United States of
America, Title 21, Food and Drugs, chapter 12, Meat
Inspection. (To the witness): That is something you would
       be familiar with?
       A. Yes.

MR. JUSTICE BELL: Read from it but try to take it slowly.
Speak up because he may be familiar with it but others may
       not, including me.

MR. RAMPTON: I wonder if it has a reference and then perhaps we
       can find it?

MS. STEEL: I think it was document 42 but I am not really sure,
       to be honest.

  MR. RAMPTON: 42 in what?

MR. MORRIS: It was served by the Plaintiffs, I believe.

MS. STEEL: I think it was served quite a long time ago.

MR. JUSTICE BELL: Is it quite a short point?

MS. STEEL: It is a short point.

MR. JUSTICE BELL: Just read out the bit but take it slowly and
loud and clear so we can follow it.

MS. STEEL: "The term 'adulterated' shall apply to any carcass
or part thereof, meat or meat food products under one or
more of the following circumstances". Then No. 2 says:
"If it bears or contains (by reason of administration of
any substance to the live animal or otherwise) any added
poisonous or added deleterious substance (other than one
which is (i) a pesticide chemical in or on a raw
agricultural commodity". I do not know whether you want to
look at this, but I wanted to ask whether it is correct
that pesticide residues are excluded from the regulations
       about -----

MR. JUSTICE BELL: What is the answer to the question?
Pesticides which have been sprayed on crops and eaten by
cattle, it is suggested would be excluded from the
       definition of "adulterated"?
       A. That is correct.

MS. STEEL: So it would be acceptable, it would be legal, to
have just pesticide residues? That would not be contrary
       to the regulations?
       A. That is correct.
