     1        Defendants treat this schedule as if it was there for their
     2        own convenience alone.  Mr. Morris sometimes speaks of
     3        co-operation from time to time.  I apprehend what he means
     4        by that is that other people should move around to suit his
     5        convenience and I really do say, and I say it with some
     6        feeling, that if the Defendants cannot guarantee to finish
     7        Dr. Gomez Gonzalez after six days of cross-examination,
     8        then I really do not know what the world is coming to.
     9        I will not say any more.

    11   MR. JUSTICE BELL:  I am not asking you to guarantee that.
    12        I really think it ought to be possible to finish
    13        cross-examination in four days.

    15   MR. MORRIS:  It is possible.  I do not know if you may recall
    16        the part of the lengthy reasons for lengthy
    17        cross-examination of Dr. Gomez Gonzalez is that questions
    18        did take a long time to reach a conclusion.

    20   MR. JUSTICE BELL:  You have this advantage, that you are going
    21        to have -- we will start from this.  I am not minded to say
    22        that Dr. Pattison must come back on Monday and, therefore,
    23        cancel his arrangements.  What I would like you to do is
    24        you go through, and it gets to later into this afternoon,
    25        think of a moment, even if it is just a little earlier than
    26        usual, where there is a real natural break in the areas you
    27        have to cover.

    29        I would like to go on for as much as the normal day as we
    30        possibly can but bear that in mind.  I will merely say at
    31        this moment that it is my view that a witness ought to be
    32        provided, whoever it is, for Friday, 3rd March.  By not
    33        later than Tuesday afternoon, 28th February, we will know
    34        whether we are going to get to that witness or not.

    36   MR. MORRIS:  Yes, that is a good idea I think.

    38   MR. JUSTICE BELL:  It matters not to me whether it is
    39        Dr. Pattison or Mr. Bowes.

    41   MR. RAMPTON:  My Lord, we will do what we can.  It might be that
    42        it would be somebody else because neither of those
    43        gentlemen can attend.

    45   MR. JUSTICE BELL:  If you are contemplating it being someone
    46        else, if you can let the Defendants know as soon as
    47        possible.

    49   MR. RAMPTON:  Yes, that is what we habitually do.  That is what
    50        this schedule was intended to do when it was presented as a 
    51        suggestion at the beginning of term.  It is supposed to be 
    52        helpful.

    56   MR. JUSTICE BELL:  I am keen to get on with Dr. Pattison.  Is
    57        there anything more we can usefully say at this stage?
