Day 079 - 27 Jan 95 - Page 13

MR. JUSTICE BELL: Can I ask, in case there is an argument in
the future, do all the parties positively want me to read
this in advance, because it is the kind of document I take
home to read at the weekend and read in an armchair, rather
than in court or in my room -- you can imagine how much
pleasure it gives me to do so. But I will take the
opportunity to do that if everyone wants me to do so.

MR. RAMPTON: I have absolutely no -- I do not want your
Lordship to do so as our belief is your Lordship may have
better things to do but -----

MR. JUSTICE BELL: I will do it, unless you object.

MR. RAMPTON: I have no objection so long as the Defendants do
not take that as some kind of indication that they can then
start reading out passages from it in open court.

MS. STEEL: We will be calling a witness so that we can do that.

MR. MORRIS: That will probably waste more time.

MR. JUSTICE BELL: Carry on cross-examining Mr. Walker. We owe
it to Mr. Walker to get through with him as soon as we can.

MS. STEEL: If you can turn to page 12 under the first paragraph
under "McKey's", can you just read that and tell us whether
       it is correct or not?
       A. The first paragraph is not correct, no. It is only in
detail though. I can explain it to you, if you wish.

  Q. Yes, please.
       A. We do not supply Belgium now.

  Q. But did you at that time?
       A. Yes. We did not supply Eire then; we only supply some
       products to Eire.

  Q. Which were they?
       A. At that time we were supplying the quarter pounder beef
       burger.

  Q. Carry on.

MR. JUSTICE BELL: You said "carry on", what do you mean by
       that?

MS. STEEL: I thought there might be more -----

MR. JUSTICE BELL: No. Is there anything else you disagree with
       in that paragraph?
       A. No, sir.

MS. STEEL: So only 10 per cent of production from the
       Scunthorpe plant goes to ---

MR. JUSTICE BELL: "Went at that time", I think.

MS. STEEL: -- at that time went to supermarkets rather than
       McDonald's?
