Day 078 - 26 Jan 95 - Page 28

MR. JUSTICE BELL: We have not had a five-minute break. I will
not leave court, but let us have a two or three minute
break to give you an opportunity.

MR. MORRIS: Can we go to the statement of Ray Cesca, head of
global marketing for McDonald's Corporation. It is the
Plaintiffs' witness statement. I am not sure what number.
Can someone help me there? You know Ray Cesca, do you?
       A. No.

MR. JUSTICE BELL: Let us just find his statement.

MR. MORRIS: You have heard of him?
       A. I have heard his name mentioned.

MS. STEEL: Volume yellow XI, tab No. 1.

MR. MORRIS: If you look at page 9 of his statement, at the
bottom of his signed statement, from June 1993 he says:
"McDonald's opened the first of its seven restaurants in
Costa Rica in December 1970. Whilst it is correct that
Coope Montecillos supplies meat to McDonald's in Coast Rica
and has done since December 1970, this meat comes from
ranches in areas which were deforested in the 1950s and
early 1960s." So, McDonald's have used beef from
       ex-rainforest land?
       A. I do not know anything about this. This is Costa Rica,
       not Brazil.

  Q. I understand that. The point I am making is ----

MR. RAMPTON: My Lord, Mr. Morris, is making a speech on the
       documents.

MR. MORRIS: I am not making a speech.

MR. RAMPTON: Mr. Morris is making a speech. If he has a
question to ask Mr. Walker, let him do so.

MR. MORRIS (To the witness): In the light of that, you actually
specifically said in your original letter, and there is a
lot of evidence on Costa Rica which will be coming up
       later.

MR. JUSTICE BELL: The point is that that is a comment, in
effect. If, having suggested that there is a disparity
between the two, which is fir comment to me rather than for
the witness to give evidence on, you want to ask him a
       question ---

MR. MORRIS: Yes, related to ----

MR. JUSTICE BELL: -- then do.

MR. MORRIS (To the witness): So when you say: "Our man in
Canada", that is George Cohon who was quoted, "is not one
who would lie to the President of the World Wildlife Fund"
and he had actually written to the World Wildlife Fund in
February 1983, in my submission, lying -----
