Day 076 - 18 Jan 95 - Page 42

MR. JUSTICE BELL: I wanted to ask my questions before you had
       an opportunity to re-examine.

  MR. MORRIS: I am sorry.

MR. JUSTICE BELL: I am not suggesting you should have, but now
is your opportunity, as you know, to re-examine if you wish
       to.

                    Re-Examined by the Defendants

MR. MORRIS: Could I have the photographs back?

MS. STEEL: I think you did actually say this already, but just
for the sake of clarification, as far as you are aware the
Coca Cola cups in those photographs, do they originate from
       McDonald's?
       A. Well, I mean they are the typical McDonald's Coca Cola
cup, but whether those came from there or anywhere else
       I could not say.

MR. MORRIS: These photographs 8 and 9 that you took, sorry, did
       you say when they were?
       A. I said I thought they were after our September meeting.

MR. JUSTICE BELL: It may have been the one three months
       earlier.
       A. It could have been the one three months earlier.

MR. MORRIS: In that letter about sitting on the McDonald's
committee, I have a few bits and pieces, not in any
particular order. It did say in the letter for more than
two years now your committee has been striving to mitigate
the many nuisances caused by McDonald's rubbish in the
environment. Then in brackets, "It includes environment/index.html">litter as one
of the nuisances". You said that you drafted up this
       letter?
       A. I said I helped.

  Q. 795, is it your recollection that that was one of the
nuisances which was going to be looked into by the action
committee? I think you answered Mr. Rampton it was not,
environment/index.html">litter was not going to be looked into as an actual legal
       advice problem?
       A. I could not exactly say, but I know that environment/index.html">litter was
item No. 3. It was the least important item on the agenda
       for the action committee.

  Q. In terms of getting legal advice?
       A. Right.

  Q. Just on the subject of the railings at Burton Court, it is
just a question that struck my mind. Apart from people's
front gardens and basements, is it true that environment/index.html">litter ends up
       in people's gardens and basements?
       A. There are no front gardens in Smith Street.

  Q. In the area in general?
       A. Markham Square and Wellington Square both have gardens
and they get environment/index.html">litter in there, yes, but then again -----
