     3        A.  Yes, in fact I think one of them is.

     5   MS. STEEL:  Can I just clarify something, which is that
     6        Mr. Rampton appears to be saying -- I am not sure whether
     7        he is saying it or not -- that the Coca Cola cups are not
     8        part of he McDonald's environment/index.html">litter.  Can he clarify whether he is
     9        saying that or not?

    11   MR. RAMPTON:  I will certainly conduct my cross-examination in
    12        my own way without any help from Ms. Steel.

    14   MR. JUSTICE BELL:  There is no need to keep firing off like
    15        that, Mr. Rampton.  Every time you do something like that,
    16        if I may say so to someone very senior in Silk and with a
    17        great deal of experience in this case, it just sends the
    18        temperature up and we go backwards.

    20   MR. RAMPTON:  Perhaps because my temperature goes up when I get
    21        that kind of interruption from a sitting position.

    23   MR. JUSTICE BELL:  Without going into personalities, Ms. Steel's
    24        goes up, Mr. Morris, by and large, keeps his head down,
    25        which is very sensible of him, but it is not necessary
    26        really.  I have said it once and I do not want to say it
    27        again.  You can place your objections fair and square
    28        without winding up the other side.

    30   MR. RAMPTON:  I decline to respond to that intervention.  If
    31        there is an objection to be made to my cross-examination,
    32        then let it be made in the proper form and I will respond
    33        to it if your Lordship wishes me to do so.

    36        You are not suggesting that all the rubbish in those first
    37        two photographs is McDonald's environment/index.html">litter, are you?
    38        A.  I never have done, no, sir, but I would say that,
    39        looking at it now, a good 70 per cent is, yes.

    41   Q.   I am not suggesting it is not an eyesore as it sits there.
    42        Are you familiar with the pamphlet "Litter and the Law"
    43        that is put out by the Tidy Britain Group?
    44        A.  Yes.

    47        there is?
    48        A.  I have seen it.  I have copies at home.

    50   Q.   It looks as though it is right, is it not, that that environment/index.html">litter 
    51        you photographed there, collectively or cumulatively, is 
    52        somewhere between grade C and grade D according to the 
    53        examples given in the middle of the leaflet?  Would you
    54        like to look it out?  It is not as bad as the one on the
    55        right, grade D, but it is perhaps slightly worse than the
    56        grade C one?
    57        A.  Yes, I would accept C and a half, sir.

    60        frequent, irregular?
