Day 076 - 18 Jan 95 - Page 28

those meetings, it is no use asking a witness in the
witness box what Dr. Taylor may have said about them or
what was said at the meetings about them. Even if it were
admissible, one would be dubious as to what weight could be
attached. I do not know whether if you called Dr. Taylor
he would help you or hinder you, but that is your route, or
one of them, if you wish to take it.

MR. MORRIS: If we look at 779, the Royal Hospital Ward
Residents Association's letter to the Executive Vice
President of McDonald's, Mr. Philip Cobden, at the bottom
of page 1 under "Litter" it states in that letter: "The
regular McDonald's patrol system has broken down". This is
1993, September 1993. Do you recall the patrol system
       breaking down?
       A. Yes, it certainly broke. It has been broken down or
non-operative for the last two and a half years.

  Q. I am just trying to flip through them because I am not
going refer to hardly any of them.

MR. JUSTICE BELL: Go through deciding quietly to yourself which
       ones you want to raise.

MR. MORRIS: If you go to No. 790, is that a headed notepaper
       you recognise?
       A. Yes, that is our Association.

  Q. Alison Robertson is the Secretary?
       A. She was then; we change every two years.

  Q. Right. Can you read the first couple of paragraphs?
       A. Yes.

  Q. As at November 1993 and now do you agree with those two
       paragraphs?
       A. Yes.

MS. STEEL: On page 788, there is a letter which has an address
at the top, 38 Smith Street?
       A. Yes, right.

  Q. Is that close to your house?
       A. Well, it is, whatever it is, 38 minus -- 47 minus 48,
12 houses or 11 houses. It is Geraldine Higson, if you
cannot read the signature -- Mrs.

  Q. Do you know her?
       A. Yes.

MR. JUSTICE BELL: Does she still live there?
       A. Yes.

MS. STEEL: She says that the Smith Street Residents Association
opposed the opening of McDonald's; that is correct, is it?
       A. Yes, that is when they were applying for around the
corner. There was an empty basement around the corner from
us, almost between the corner of Smith Street and Marks &
Spencers, and McDonald's tried to get in there first and
       that really worried us.
