     3   MR. MORRIS:  One question I was going to ask -- you have said in
     4        your statement:  "Our Association has raised the matter of
     5        environment/index.html">litter with McDonald's on a continuous basis over the
     6        years".  When you say your Association, is that the Smith
     7        Street one or the Royal Hospital one or both?

     9   MR. JUSTICE BELL:  I think we had better put the statement in
    10        because you keep saying "what is said in the statement", so
    11        let us do that formally, shall we?  I have a statement
    12        signed by you, Mr. McIntyre, dated 27th January 1994.  Do
    13        you remember that you did sign a statement?
    14        A.  I certainly remember signing a statement.  I have seen
    15        copies of it but I could not remember it.

    17   Q.   You stand by what you said in that statement?
    18        A.  Oh, yes, indeed.

    20   MR. MORRIS:  Sorry, I did not realise it could not be quoted
    21        unless it was taken as read.  You say your Association,
    22        which do you mean there, has taken up the matter with
    23        McDonald's over a number of years?
    24        A.  I think I was probably speaking of Smith Street then,
    25        yes.

    27   Q.   Do individuals also take up the matter with McDonald's as
    28        well?
    29        A.  I imagine so, yes.  I mean, know they have told me they
    30        do so but that may be hearsay.

    32   Q.   You said that you talked to the manager at McDonald's.
    33        What do you remember about that?
    34        A.  No, I talked to a manager at least when I went to
    35        complain about one particular Sunday morning when it was an
    36        absolute mess.  I went in and said:  "Could I speak to the
    37        manager?" and it was not Mr. Siddique who I now recognise,
    38        because we have met in Council before.  It was a tall dark
    39        girl who was, obviously, the assistant manager on duty that
    40        day.

    42   Q.   Or somebody representative anyway?
    43        A.  Well, she answered.  I said:  "I want to speak to the
    44        manager" and she came forward so I presume she was.

    46   Q.   What time on a Sunday morning was that, approximately?
    47        A.  I would have said it was 10 o'clockish, but I am only
    48        guessing because I do not remember.

    50   Q.   How often do you see her? 
    51        A.  I have only been in there twice.

    53   MR. JUSTICE BELL:  Let us take it step by step.  We have this
    54        occasion.  I suggest you deal with that and then you can
    55        ask Mr. McIntyre about any other occasion.

    57   MR. MORRIS:  There is one occasion you spoke to a tall, dark
    58        woman on a Sunday morning, mid morningish or something like
    59        that?
    60        A.  Yes.
