Day 076 - 18 Jan 95 - Page 19
A. Neither of the meetings are -- we have only once had a
vote.

Q. When the residents, say, the Royal Hospital Ward Residents
Association or the Smith Street Residents Association wrote
to McDonald's or the Council about the environment/index.html">litter issue in
McDonald's, were they representing just the views of the
officer that wrote or were they representing the views of
those that attended the Association's meetings?
A. Well, if they were written after a meeting they would
be representing the meeting's views.

MR. JUSTICE BELL: The officer who writes the letter does his or
her best, you would say, to accurately and faithfully
reflect such consensus as there has been at the meeting; is
that right?
A. That is right, sir. Yes, generally somebody says, you
know: "Resolve that we write McDonald's, or resolve that
we write to the Council" and the officer does the writing.

MR. MORRIS: So just to clarify, it is not the personal views of
the officer when they write a letter under the heading of
the Smith Street Residents Association or Royal Hospital
Ward?
A. It should not be; we have had incidences in the past
when officers have.

Q. On this subject, the letters that -- you have briefly
looked at some of these letters, I believe ---
A. Yes.

Q. -- as far as you are aware, were they the views of the
Association as whole or just the views of the officers?
A. As far as I know, the views of the Association as a
whole, in fact, I am almost certain in each case.

Q. How would you know if the McDonald's patrol did or did not
come up and down your street?
A. I am retired and I work at home. I work at a desk
which looks out over Smith Street. I am at that desk,
I suppose, five hours a day, seven days a week, so I
am very well aware of what goes on in the street.

Q. What floor is that window on?
A. It is the ground floor.

Q. So you can see the street directly?
A. Oh, yes.

Q. You do not have to crane your head or anything?
A. No. Anybody passing my window, I am afraid, is in full
view.

Q. Do you have lace curtains over the windows?

MR. JUSTICE BELL: He said he can see.
A. My wife does not belief in lace curtains.

MR. JUSTICE BELL: Leave Mr. Rampton to cross-examine about lace
curtains, if he wants to. He said he can see what is
