     2        Mr. McIntyre?
     3        A.  Again, sir, I think from -- it must have been late
     4        summer or early autumn.

     6   Q.   Last year?
     7        A.  Yes, last year.

     9   MR. MORRIS:  Shall we look at No. 8?
    10        A.  No. 8 and No. 9 are the same scene which is outside
    11        McDonald's back door, where the rubbish which they store in
    12        bin bags there has been torn apart or fallen apart or been
    13        blown apart.  You can see the mess it is.  I was on  -----

    15   Q.   What time of the day is this?
    16        A.  This was, this I do remember and I can actually
    17        identify the date.  I think it was in September because
    18        I had been to a meeting of the Royal Hospital Wards
    19        Association at which we had discussed environment/index.html">litter.  I may
    20        have said:  "You see what it looks like now", and so I went
    21        back and got my camera and then took the picture.  So it
    22        was -- I can give you the exact date on that one -- I think
    23        it was sometime in September but -- yes, it was Monday,
    24        12th September 1994.

    26   Q.   In the evening?
    27        A.  In the evening.

    29   Q.   What time of the evening would that have been?
    30        A.  Well, the meeting is at 7.00 and goes on for about an
    31        hour and a half, so it must have been about 8.45.  It may
    32        have been earlier; sometimes they do end earlier.

    34   Q.   You say the bins were over-flowing; is there any other
    35        problem there with regards to material coming out of bins?
    36        A.  You always see a lot of grease there because every time
    37        a bag bursts it has often got greasy substances in it, but
    38        actually the grease here is obscured by the rubbish -- at
    39        least I think it is, I am only guessing.

    41   Q.   While we are on that subject, have you noticed bags of
    42        rubbish outside McDonald's, how long did they normally stay
    43        there or how long have you observed them?
    44        A.  It varies, but it can be anything up to four hours.
    45        Last night I went round, in fact, at 6.15 and there were 15
    46        bags of rubbish and I went round again at 8.15 and the same
    47        15 bags were there.  I remember Mr. Stump assuring the
    48        court that they were only out there for half an hour before
    49        collecting time.  They were there definitely, to my
    50        knowledge, for two hours yesterday.  Yes, I took 
    51        photographs of them but I have not developed them.

    53   Q.   You took photographs of both times, did you?
    54        A.  No, I did not actually.  I took it the second time.

    56   Q.   Is this something that the Residents Associations have
    57        brought up, this?
    58        A.  Not ours, of course.  Royal Avenue bring it up, yes.
    59        I think there was a letter, in fact, of complaint from
    60        No. 4 Royal Avenue about these bin bags outside.
