Day 076 - 18 Jan 95 - Page 09

       and when?
       A. 3 and 4 were taken on the same day again sometime in
1994. They are down at the far end of Smith Street which
is, in fact, called Durham Place. In fact, it has another
name further on as well, Ormonde Gate. It is, in effect, a
continuation of Smith Street but it becomes Durham Place
and then it becomes Ormonde Gate.

MR. RAMPTON: My Lord, might he be asked to hold it?

MR. JUSTICE BELL: Yes, can you hold each one up as you refer to
it; it refreshes our memory of them.
       A. 3 and 4. These are the ones down in Durham Place.

MR. MORRIS: I notice on the map that Durham Place is not
actually mentioned. Smith Street becomes Ormonde after the
corner of Burton's Court. So, is it beyond Leonard's
       Terrace?
       A. At St. Leonard's Terrace it becomes Durham Place for a
block and then it becomes Ormonde Gate which is a road that
       goes round in a square.

  Q. So that is really just south of the corner of Leonard's
       Terrace and Smith Street?
       A. That is right. It is a continuation of Smith Street
       after St. Leonard's Terrace.

  Q. Do you remember when they were taken?
       A. No, you know, within a year but no more than that.

  Q. Would you like to go on to No. 5 and hold it up?
       A. Yes. No. 5 was taken on a Saturday which is why it is,
or a Sunday morning even, which is why the streets are so
empty. You can see the rubbish clearly. That is No. 5.

MR. JUSTICE BELL: Could we see that?

MR. MORRIS: That is Smith Street, is it?
       A. That is No. 48 again.

MR. JUSTICE BELL: That is looking towards the Kings Road, is it
       not?
       A. Looking towards the Kings Road.

MR. MORRIS: Is that the one that had a similar set of rubbish
       to the previous one?

MR. JUSTICE BELL: I think that is the same rubbish as 1 and 2?
       A. 1 and 2, I think it might easily be.

MR. MORRIS: As we are passing, you say that there are not many
       cars around because why?
       A. Because it was a Sunday.

  Q. Is it normal then to be fairly crowded with cars during the
       week?
       A. Yes, very crowded -- I mean, you cannot park.

  Q. Chocabloc?
       A. You cannot get a park in Smith Street after about 6.30.
