Day 076 - 18 Jan 95 - Page 08

MR. MORRIS: Before we look at specifics, what is your general
feeling about McDonald's environment/index.html">litter in your street, in your
area? How do you feel about the situation over the last
       few years?
       A. Well, I object to environment/index.html">litter in front of my house and in my
basement. It is as simple as that. I do not really see
why I should be condemned to environment/index.html">litter for the rest of my
       life.

  Q. If you look at the photographs, if you just open them up
and look at them -- I do not know. What is the practice on
       this?

MR. JUSTICE BELL: It would help me -- the first essential thing
with the photographs, in relation to each one, number by
number, and you can go straight through them or take them
one at a time or and then ask more about them -- I should
know where they were taken, on what date, at what time of
the day, in so far as Mr. McIntyre can help in relation to
that; if he cannot be precise, some general indication.
So, whatever else you ask Mr. McIntyre about, ask him that.

MR. MORRIS: First of all, did you take all these photographs
       yourself?
       A. Yes.

  Q. Can you just go through them one at a time and just say the
number -- No. 1, do you know where that is?

MR. JUSTICE BELL: Hold it up so everyone can see and remind
themselves of it. Yes, thank you.
       A. Yes, that is in front of 48 and more or less in front
of 47. In fact, you can see my door is open as I have come
out of it. So, it is really in front of 48.

MR. MORRIS: OK. It does not have to be the exact spot but it
is basically near your house. What about this No. 2?

MR. RAMPTON: No, my Lord. Could we have the date and the
       time?

MR. JUSTICE BELL: Do the time and date in so far as you can.
       A. There, I am afraid you have got me, sir. I can give
       you a very rough idea.

  Q. Do your best, Mr. McIntyre.
       A. I would say the first two must have been taken sometime
in 1994 probably. Judging by the look about it, it must
have been the summer of 1994, but it may have been
earlier. But certainly I did not make a note of dates,
       I am afraid.

MR. MORRIS: No. 2, is that in the same position?
       A. That is the same from a different angle.

MR. JUSTICE BELL: That is the same rubbish, is it not?
       A. Yes.

MR. MORRIS: Can you go on to No. 3, please, and just say where
