Day 065 - 09 Dec 94 - Page 73
MR. JUSTICE BELL: You see, that leaves just 24 per cent who in
their answers have shown no evidence of understanding the
purpose of the commercial.

MR. MORRIS: Yes, but it also would imply, if that was true,
that 75 per cent did not understand that commercials were
showing products that were available at the stores.

MR. JUSTICE BELL: Why do you say that?

MR. MORRIS: Because if only one out of four children understood
that, for example, it could show you things -----

MR. JUSTICE BELL: No, I do not think you listened to the way
I read it out, do you see?

MR. MORRIS: That is what the questions were asked. Whether the
children were asked three questions and then they chose the
ones they agreed with, in which case 75 per cent did not
accept they would show you things you could buy and 71 per
cent -----

MR. JUSTICE BELL: I think we should ask the witness because
this may be a matter of argument in due course.

MS. STEEL: Can I make a suggestion which is that there is,
obviously, insufficient information in this document to be
able to establish in exactly -----

MR. JUSTICE BELL: You can make that suggestion at the end of
the day.

MS. STEEL: It might just save time.

MR. JUSTICE BELL: Remember we have Ms. Dibb in the witness
box. I was only trying to help. Every time I come in to
try to help it turns out to be counter-productive; I have
either interrupted Mr. Rampton's cross-examination or
I have not put what you think.

MR. MORRIS (To the witness): Ms. Dibb, do you feel, having
looked at these figures and the explanation or whatever,
that you could rely on the findings of this survey?
A. I hear what has been said about adding up those figures
and what your Lordship has said, but what is not clear is
how the interviews were really conducted. I am not
entirely clear as to ----

MR. JUSTICE BELL: I understand that point.
A. -- whether they were asked all three of those questions
or whether they were asked to choose one of them. It does
not seem to help us in this particular paper on that point.

Q. You do not know whether they were leading questions or not,
do you?
A. No, it is not .....

MR. MORRIS: Just a legal point, we will ask the judge: I would
have thought that anyway it is not evidence in itself
unless the Plaintiffs are prepared to bring the
