MR. TERENCE STUART MALLINSON, Recalled.
Cross-Examined by the Defendants

MR. JUSTICE BELL: I have a sheet which is various conversion
calculations and an addendum to Mr. Mallinson's statement
which is dated today, 30th November. Have you a copy?

MR. MORRIS: We just got a copy about a minute ago.

MR. RAMPTON: It is what your Lordship asked us to do.

MR. JUSTICE BELL: Yes. It is probably helpful if we just read
that, is it not, and have a look at it?

MR. MORRIS: I have only one copy. (Pause).

MR. JUSTICE BELL: How do you suggest we approach this,
Mr. Rampton? I asked for the information, I have to say,
because for the first time during Mr. Morris'
cross-examination it appeared that in due course he might
argue -- I do not know whether this is Ms. Steel's case and
his -- that in so far as there are figures like 800 square
miles, it is not what is actually being chopped down in any
one year, it is what is required in order to provide year
by year. At the end of the day, if that is argued, I may
or may not decide that that is a meaning which the words
actually bear, but one has to face the potential argument.
Therefore, subject to anything Mr. Morris and Ms. Steel
say, I would like some evidence like this in because at the
end of the day it might be helpful to me one way or the
other.

On the other hand, I readily confess that it took a bit of
thinking before I understood the calculations in
Mr. Mallinson's original statement. I am not at all
confident I understand everything which is here. That is
the first thing; the second is I am not quite sure what is
Mr. Thompson's contribution and what is Mr. Mallinson's
contribution among it.

MR. RAMPTON: Of course, I understand that. Naturally enough,
I prefaced this topic with the observation that that
interpretation of the leaflet might be appropriate had it
been a specialist forestry application. But, my Lord, that
is in the future. May I suggest the best thing is if your
Lordship takes it up with Mr. Mallinson. It was your
Lordship's question. I did not ask any questions in-chief
and if I have to come back in re-examination, so be it, but
at the moment I do not foresee any likelihood of that. If
your Lordship should wish Mr. Mallinson to explain how it
works and which is his contribution and which is
Mr. Thompson's, although I think one can see from the type
face probably which is which, then I suggest your Lordship
asks him to explain, if that is all right.

MR. JUSTICE BELL: Yes. What would you like to do,
Mr. Morris?
