     1        Tuesday 29th, which it would be my suggestion we use to
     2        complete the argument on amendment.

     4   MR. MORRIS:  Amazingly enough, we are not objecting to that.  It
     5        is going to be a pretty heavy week, but, to be honest, any
     6        break of half a day or a day in a week means we can
     7        organise our paper work, whatever.

     9   MR. JUSTICE BELL:  I had forgotten the morning of Wednesday
    10        29th.  I think we should come back to the argument on the
    11        amendment.  At most you probably had about an hour to go
    12        for the remainder of what you wanted to say on F and your
    13        submissions on L.  Mr. Rampton has said he would not be
    14        very long.

    16   MR. RAMPTON:  My Lord, what I will do in the light of that, if
    17        that is a fixture, well, in any event actually, is to send
    18        to your Lordship and to the Defendants a list of references
    19        from the evidence-in-chief mostly, though there is some in
    20        cross-examination, of Dr. Barnard which I have made for the
    21        purposes of my reply, as I did with Dr. Arnott.  I will do
    22        it in good time before next Tuesday morning.

    24   MR. JUSTICE BELL:  I propose to say no more at the moment about
    25        the week after, the week beginning Monday 5th.  I would be
    26        grateful if efforts were made to make sure that Mr. Hopkins
    27        can attend at the beginning of that week and Mr. Van Erp,
    28        and sometime, perhaps close of play on Wednesday or during
    29        Thursday when we have seen how we have done with
    30        Mr. Mallinson and whether we have got into Mr. Oakley and,
    31        if so, how far, we will have another think about the week
    32        beginning Monday 5th.

    34   MR. RAMPTON:  Meanwhile perhaps, my Lord, it would help if
    35        Ms. Dibb would tell the Defendants what her availability
    36        might be in the week beginning the 5th, because obviously I
    37        would like to finish her as soon as possible.

    39   MS. STEEL:  Did Mr. Rampton say how long he thought he might
    40        be?

    42   MR. RAMPTON:  No.

    44   MR. JUSTICE BELL:  No.  He could not be confident that he would
    45        finish his cross-examination in half a day.
