Day 055 - 25 Nov 94 - Page 71
purpose outside of the actual conduct of the case in court.

MR. RAMPTON: Or the fair reporting of it or whatever.

MR. JUSTICE BELL: But there is no problem about this, is
there?

MR. RAMPTON: None at all.

MS. STEEL: It is Mr. Rampton who is making a big problem out of
nothing, basically.

MR. JUSTICE BELL: Ms. Dibb, if you have been given a copy of a
document which is a document disclosed in the case, and
which has not actually been read out in full in court,
I would be obliged if you would just keep it in your own
possession with a view to using it, until you are told
otherwise, only in answering any question you are asked in
the witness box. Do you understand?

THE WITNESS: I do understand.

MR. JUSTICE BELL: Was there anything else before we just have
any discussion which we may usefully be able to have about
Ms. Dibb's return?

MR. RAMPTON: The position at the moment is, as your Lordship
knows, Mr. Mallinson is due on Monday. He could come back
on Wednesday, if required, but in view of the fact that
I am not going to be asking him any questions in-chief, it
may be -----

MR. JUSTICE BELL: I think we will just have to wait and see
whether he is required to come back on Wednesday.

MR. RAMPTON: At the moment Tuesday morning 29th is a blank with
Professor Ashworth in the afternoon. It might be, I do not
know, that there will be some space at the end of the week
following because at the moment we have still not been told
what witnesses the Defendants are calling on recycling and
waste and, if so, when.

MR. JUSTICE BELL: What is the best estimate you can give of
cross-examination of Ms. Dibb because, if it is likely to
be more than half a day, then it would be much better that
she came back on what was otherwise a clear day, so she
only returns once, would it not?

MR. RAMPTON: Of course, it would. Did I do half an hour this
afternoon or slightly longer?

MS. STEEL: An hour.

MR. JUSTICE BELL: Yes.

MR. RAMPTON: The morning session is two and a half hours, the
trouble is there is quite a lot to read.

MR. JUSTICE BELL: That is why I had my doubts about it with the
best will in the world -- do you have a suggestion?
