Day 050 - 10 Nov 94 - Page 40

MR. MORRIS: I can make another phone call.

MR. JUSTICE BELL: Obviously, one would like to sort it out now,
and then everyone can concentrate on other matters for the
rest of the day. But it seems to me that what we have
probably got to do, unless it causes disastrous
inconvenience to anyone, is reassemble at two o'clock to
       see where we are.

I am content to wait for five or ten minutes, but I would
like you to respond, unless there is some particular
difficulty, to the point which Mr. Rampton has mentioned.

We have to consider Miss Dibb's position; and then it will
probably be useful, in the light of whatever her position
is, just to see what we are going to go on to next and
       when.

MR. MORRIS: May it be to convenient to break now for lunch and
       come back at two?

MR. JUSTICE BELL: Break now and come back at two o'clock.

MR. RAMPTON: My Lord, it may be that for one reason or another
the Defendants actually might benefit from having a bit
       more time than that.

MR. JUSTICE BELL: Do you want more time? I will be in the
building for the rest of the working day, so there is no
problem as far as I am concerned.

MR. MORRIS: No. I think two o'clock is fine. There is no
point in leaving it until -- if Miss Dibb is not in, she
may not be in at three or half past three, either. I do
not know. It would be silly to wait on the off chance.

MR. JUSTICE BELL: I will come back at ten past two. I would
like one of you to telephone Miss Brinley-Codd, if you need
more time, so that she, Mr. Rampton and Mr. Atkinson do not
have to come back to find that there is a wait. I would
like one of you to come back to court, so that if you do
need more time you can tell Mr. Stiles, who will come up at
about two o'clock. But otherwise we will come back at ten
       past two.

                      (Luncheon Adjournment)

                                                    2.15 p.m..

  MR. JUSTICE BELL: Yes?

MR. MORRIS: We phoned Miss Dibb throughout lunch-time. We got
hold of her at about ten past two. The position as we see
it is that she says she is still very shaky. She has seen
the doctor who has advised her to get rest. She does not
want to hold up proceedings, but does not feel that she
could give evidence next week before she goes away, but is
prepared to come to court on Monday morning, if she has to,
to say whether she then feels she is able to give
