Day 048 - 08 Nov 94 - Page 28

through all the sheets to try and remind yourself if you
have a question to ask on it. If you go on with the next
stage of your cross-examination, and then you can spend a
few minutes during the midday break checking that, if you
       are anxious about it.

I have to say that, in a case of this length, it is a fact
of life that it is not realistic to remember every point
you were going to put. Counsel, supported by junior
counsel and solicitors, could not hope to put every point
he first thought of. It is just not the reality of long,
       complicated litigation.

MR. MORRIS: I want to go on to the ITC Code. Have you read the
       transcripts from Mr. Miles----
       A. No, I have not.

  Q. ----his evidence yesterday. So you are not aware of what
       the issues were yesterday?
       A. No, I am not.

MR. MORRIS: Well, if we get the ITC Code out, which should be
tab 1 of that folder. I think it would be helpful if we
       had the 1993 Code, really.

I believe you said -- or Mr. Green said, but would you
agree -- that you feel that McDonald's has higher standards
than the codes that actually exist in the UK? Would you
say that is a fair comment?
       A. I think there are elements to our code that perhaps go
further as a restriction on us than the standard code, yes.

  Q. Does that apply to nutrition and health, and health issues
       generally?
       A. I am not sure how to interpret that.

  Q. Well, put it this way: is there anything in your
Golden Arches Codes about any standards to do with
       nutrition?
       A. I think, from memory, they are general advertising
       principles.

  Q. There is an enormous amount of detail about the specific
       characters and their roles?
       A. Yes.

  Q. But there is actually nothing about nutrition, at all, is
       there?
       A. If you say so. I cannot remember everybody single
word. I will take your word for it.

  Q. You can take my word for it that, as far as I can see, the
only thing I can find that is anything to do with nutrition
is "see a lawyer" or "get advice"; there is no actual
guidance beyond that, from your memory, anyway?
       A. I cannot recall any more than that, no.

  Q. But you are concerned about the public's health, as a
       company; yes?
       A. Of course.
