Day 047 - 07 Nov 94 - Page 59

company documents, what language they use to arouse
enthusiasm among their staff or their franchisees I think
is a rather different matter. That is not an advertisement.
It is not a document appealing to consumers.

MS. STEEL: So if an advertisement or advertisements were to try
and influence children's emotions, then that wouldn't, to
that extent, that wouldn't be something that was
       acceptable?
       A. No, I didn't quite say that. It depends on the words
that are used and the extent to which this is done. In
answer to a question earlier, I said that I thought that if
the attempt was made in an advertisement to create love by
a child, that would be going rather far, but that's not the
same thing as saying that no form of emotion is reasonable
to be shown. I think all these are a question of degree.

MR. JUSTICE BELL: I have to say that I think love may mean one
thing to an English grandfather and another to whoever
wrote that document, but there we are - in the States -
but there we are. Just take a bit of time because we are
nearly five past four and we have obviously got to spend a
minute or two discussing the schedule for the rest of the
week, but what would help me, if you could give some idea
the length of the period of time which the remainder of
your cross examination of Mr. Miles might take?
Sit down and discuss it between the two of you if you want.

MS. STEEL: I think probably about an hour, something like that.

MR. JUSTICE BELL: Remind me, Mr. Rampton --

MR. RAMPTON: My Lord, Thursday, if Your Lordship would permit
it, a two hour break in the middle because Mr. Miles has a
       pre-existing engagement. Am I right?
       A. Well, if necessary, I would be able to be here all day
       Thursday.

MR. JUSTICE BELL: But you cannot be here tomorrow, was that the
       position?
       A. I am afraid it would be very difficult indeed.

MR. JUSTICE BELL: And there was a difficulty about Wednesday?
       A. Wednesday is worse, but for Thursday I would be happy
to devote the entire day to this court, if that was a good
       idea.

MR. JUSTICE BELL: It looks as if it would not be the whole day.
Unless there is something you feel you very strongly wish
to ask Mr. Miles this afternoon, that concludes the
evidence for today. Would you like to go and sit down, Mr.
       Miles?

MR. RAMPTON: My Lord, that makes rather a mess of this weeks
schedule. At the moment we have got Mr. Hawkes coming back
tomorrow. Assuming that Mr. Hawkes was finished tomorrow,
that leaves a blank for Wednesday at the moment. A little
bit of Mr. Miles, the defendants say now on Thursday, and
another blank for the rest of Thursday and then I do not
       know what happens on Friday.
