     1        Perhaps no one else will mention it.  But there was "A",
     2        and it was well known confectionery, "a day helps you
     3        something, work and play."

     5   THE WITNESS:   "Work, rest and play".

     7   MR. JUSTICE BELL:  So that was urging you to have one of those
     8        every day.  Is it more that which was directed at, than
     9        eating a particular food?
    10        A.  It might be.  I think one a day is probably not
    11        excessive.  But if it said something----

    14        A.  Yes.

    16   MR. MORRIS:  Well, it is open to interpretation exactly what
    17        that means.

    19   MR. JUSTICE BELL:  What "excessive" means in any particular
    20        situation.
    21        A.  Indeed.  Interpretation is always a sensitive area.

    23   MR. MORRIS:   Right.  Well, the next point (b):

    25        "Advertisements must not disparage good nutritional
    26        practice and any comparisons between foods must not
    27        encourage choices likely to be contrary to good nutritional
    28        practice."

    30        That is a new section, is it not?
    31        A.  Yes, it is.

    33   MR. RAMPTON: My Lord, one does notice, referring back to what
    34        your Lordship said a moment ago, that there is a note about
    35        how it might be interpreted.

    39   MR. MORRIS: Point (c) -- this is particularly with children --

    41        "Advertisements directed to children must pay particular
    42        regard and consideration to dental hygiene.  They must not
    43        encourage children to eat frequently throughout the day or
    44        consume food or drink near bedtime, except where there
    45        could clearly be no implication to the dental hygiene, e.g.
    46        mineral water."

    48        The first part, is that new; it is a new point, is it not?
    49        A.  It is a new form of wording for an old rule.  That is
    50        what the note says.

    52   MR. JUSTICE BELL: Well, it was (a), was it not, and it is---- 
    53        A.  Yes.  Dental hygiene, my Lord, is more (b): "must not
    54        encourage children to consume food or drink near bedtime".

    60        consideration near bedtime, is it?  It is a concern
