Day 047 - 07 Nov 94 - Page 29

MR. JUSTICE BELL: It may not do, at the end of the day.

MR. RAMPTON: I am not concerned to establish -- I know that
Mr. Morris is -- I am not much concerned at present to
establish what this particular pressure group or others
think about this, that or the other topic. It does not
       decide this case.

MR. JUSTICE BELL: That may be, but the reason I assume it has
not been disclosed so far is that it only came out three
minutes ago, when you asked the question in
       cross-examination.

But none of that matters. This is not a case which is all
about one tactical advantage or another. If I am to see
what one body or another proposes, I would like to see what
       the ITC, itself, proposes.

MR. MORRIS: I think it would be helpful. I only knew about it
       this morning.

MR. JUSTICE BELL: There is no criticism of you. Let us leave
       it there for the moment.

MR. MORRIS: (To the witness) Just from memory, until we get
that code, that proposal for amendments, what are the main
changes? You are on the ITC, yes?
       A. I am on the Advertising Advisory Committee.

  Q. Of?
       A. Of the ITC.

  Q. What are the amendments?
       A. I am sorry. I do not have them in my head. I have
them behind me, but I do not have them in my head.
Presumably, until they have been formally produced, I
       cannot quote from that document.

MR. JUSTICE BELL: When you say you have them behind you, will
you dig it out, please, Mr. Miles? It is a very long route
to a short answer. If you read it out, we will get a copy
       later.

MR. MORRIS: Can you read out the preamble as well?

MR. JUSTICE BELL: How long is the preamble?
       A. The preamble is one page. The proposed rules are a
       little longer.

MR. JUSTICE BELL: I think we are just looking at the equivalent
       of 11 at the moment.

MR. RAMPTON: Might it be better, if Mr. Miles were willing to
surrender it, if we were to adjourn now, and we will get
enough copies, if you let us, made for everybody?

MR. JUSTICE BELL: Yes. Is five minutes going to make any
difference as to whether you finish cross examining
       Mr. Miles today?
