Day 047 - 07 Nov 94 - Page 26
Q. Now, if we look at ITC Code----
A. I have a copy here. Am I allowed to look at it?

MR. JUSTICE BELL: I think it would be better if we find it in
the bundle.

MS. STEEL: Pink volume VII.

MR. MORRIS: On page 13 of that ITC Code -- I do not know if it
is exactly the same as the one I have. I have got the
May 1993 one.
A. I am sorry to say the version I have here does not go
to a page 13.

MR. JUSTICE BELL: I am surprised at that. It should be the
very first sheet. You are not being given the bundle
numbers, Mr. Miles. I think you are being given the page
numbers. So it is our page 1.
A. That, if I may say so, is not the ITC Code. It is the
ITC Association Special Guidelines.

MR. MORRIS: I do not know if it is remembered that we brought
in the May 1993 Code of Practice, I think when we were
questioning Mr. Hawkes. I cannot remember now. We served
it on the Plaintiffs.

MR. RAMPTON: My Lord, I do not know if Mr. Miles has got his
own copy?

THE WITNESS: I have, of the ITC Code, yes.

MR. JUSTICE BELL: I now find that I must have been handed
something. Before divider 1, I have inserted something
which is headed "The ITC Code of Advertising Standards and
Practice May 1993", but it is appendix 1, Advertising and
Children, which includes pages 12, 13 and 14.

MR. MORRIS: That is what I would like to refer to.

(To the witness) Is that May 1993?
A. Yes.

Q. So that is the effective code at the moment?
A. Yes.

Q. If we go to the section on health and hygiene, which I
have got at page 13?
A. Yes.

Q. Is that the only section that deals with food and health
specifically?
A. Specifically where children are concerned, yes.

MR. MORRIS: Before I ask you about that, are you aware that
this section is part of the review -- is being reviewed, as
part of the----

MR. JUSTICE BELL: Can I make a suggestion? If you say, "Are
you aware that", it sounds as if you are asserting it as a
fact. It may or may not be a fact. Why not just ask him,
