Day 046 - 04 Nov 94 - Page 42

MR. JUSTICE BELL: Have a look. It is yellow VI.

MS. STEEL: No, I have got that wrong. That is something else.
       A. I thought you might have that incorrect.

  Q. Was it used in schools at all, or not?
       A. I do not believe it was.

MR. JUSTICE BELL: Did calling them "The Nutrients" have a
       particular idea?
       A. I think it was the copywriter's idea.

  Q. Or just a catchy name? Do you know? If you do not know,
       say so.
       A.  I do not know specifically why they were called that;
I can only give you my impression.

  Q. The North Eastern Circuit has a rock band, made up of
members of the circuit, called "Count 1 and the TICs"; and
I wondered if it was jokey like that, or if it has some
       particular purpose?
       A. Do you publish a schedule as to when they appear!

  Q. The point is this, that I might think it is Ronald and the
Nutrients because you are trying to portray that your food
is nutritious. I want to know whether that would be fair
or it is just a catchy name?
       A. I think it not only a catchy phrase, but I know they
were trying to talk about the basic food groups; it really
did not talk about McDonald's food.

MR. RAMPTON: If it helps your Lordship, I think it is in
       court. It might-----

MR. JUSTICE BELL: I have seen the ad. I do not want to show
that again. It was one of the -- was it not?

MR. RAMPTON: No, no. It is completely separate.

MR. JUSTICE BELL: Well, do not let us hold up Mr. Green now.
We have marked the point, as it were, and I can look at it
later. (To the witness) It is just a question of whether
you can throw any personal light on it?
       A. The only thing that I know is the intention that it was
supposed to represent the basic food groups.

MR. JUSTICE BELL: Let us look at it later, if need be.

MS. STEEL: The first thing it says is, is it not: "McDonald's
       presents Ronald and the Nutrients"?
       A. Yes, like a rock band.

  Q. Yes; and could that also sound like: "You can get Ronald
and the Nutrients at your local McDonald's"?
       A. That was not the intention of the ad, I believe.
Again, I was not part of the development specifically of
       that ad.

  Q. It also shows Ronald on a stage with these Nutrients, these
depictions of nutrients, and in the background there is a
