Day 046 - 04 Nov 94 - Page 31

Q. You would have decided what the content was going to be and
what the schedule was going to be?
A. Yes.

Q. That would have been reflected in this document?
A. That is correct.

MR. JUSTICE BELL: Can I say one thing to you? You may not be
even thinking of putting things here but, in my view, you
do not have to, because it has already been canvassed with
witnesses on both sides, including those who consider they
have some nutritionist expertise which Mr. Green has not
pretended to at all.

MR. MORRIS: On page 102, we see McDonald's food balanced one on
top of each other; yes?
A. Yes.

Q. That is the image, with the word "balance"?
A. That is correct.

Q. When a customer, or potential customer, sees that, you
would like them to think that McDonald's food is balanced;
you cannot give an opinion on whether it is or not, but
that is what you hope?
A. Yes, and that it would fit into a well balanced diet.

Q. So McDonald's food is balanced and that it can fit into a
well balanced diet?
A. I think the ad itself is very specific on the point:
"Make sure your McDonald's meal balances with other meals
you eat."

Q. And that McDonald's food is balanced, as well?
A. I think, again, if you read the ad, it is quite
specific.

Q. The image----
A. Yes. You can eat McDonald's food in a balanced way,
and you can also use McDonald's food in the balance of your
overall diet.

MR. JUSTICE BELL: Let me understand exactly what you say.
Whatever it has in the relatively small type in the bottom
right-hand corner, what is being suggested is that the
picture demonstrates McDonald's food being balanced within
itself. Do you see? Is that part of what the promotion is
intending to portray?
A. The specific thing, I think, is that the whole balance
of your food is the most important thing, and that
McDonald's can fit into a well balanced diet; that
McDonald's has a variety of items that you could use, and
you can balance them as well.

MR. MORRIS: Then, on page 104, "What we're all about", it shows
meat, potatoes and milk; yes?
A. Yes.

Q. Balanced on top of each other?
