Day 044 - 02 Nov 94 - Page 50

       was ever used again?
       A. I do not remember the wording. So, I am sorry,
       I cannot answer that.

  Q. Do you know anything about the Australian Trades Practices
       Commission -- the second paragraph?
       A. No, I do not.

  Q. It is my recollection that this paragraph has been
admitted. But it was incorrect to say that the packaging
       was ozone friendly?
       A. For example, the next one, the one for the United
Kingdom, I heard John Hawkes talk about that, in fact, it
did happen. But before that time period, I was not aware
of it. I am not aware of Australian Trade Practices
       Commission.

  Q. So you have not heard about that 1989 Australian Trade
       Practices Commission decision?
       A. That is correct.

MR. MORRIS: I cannot remember whether these documents have
been promised or looked for, relevant to the Australian
       Trade Practices Commission-----

MR. JUSTICE BELL: Might I make a suggestion? We have at some
stage got to deal with some further discovery. It has not
slipped out of my mind. You want to ask for discovery (if
they exist) of statistics with regard to employee
accidents, for instance. What I suggest is, if you think
there is incomplete discovery on any of these points, you
raise them then. This witness has said he does not know.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: For myself, unless he knows something
particular about it, I find it difficult to see how
cross-examination on it is going to really bring anything
       out.

MR. MORRIS: (To the witness) If this paragraph was true, would
that be the sort of thing that the Australian
representative at your international marketing conference
would inform the rest of McDonald's sections about, who may
be considering of course running further ads on that
theme? The theme of HCFCs replacing CFCs was a pretty
       international thing, was it not?
       A. Yes. It probably would have been much more appropriate
in some other part of the company, or aspect of the
company. Most of the time, when we talk at international
meetings, it is about promotions or activities within that
country that would be pertinent to other countries.

I do not remember this discussion. I was not at a
marketing conference where there was any discussion that
I can remember about this particular issue.

  Q. This would affect, though, all the other sections, country
       sections?
       A. It certainly would affect Australian.
