Day 044 - 02 Nov 94 - Page 20

       A. Again, I am not a nutritionist, so I do not know-----

  Q. But you would respect the view, would you, of the Surgeon
       General of the United States?
       A. Certainly, I think he is an able person.

  Q. Would the McDonald's Corporation be informed through a
       report of this nature?
       A. I could only speculate. I would not know for sure.

  Q. Did you note that there is a particular focus on foods that
are high in fats, when I quoted that?

"Chief among them is the disproportionate amount of foods
       high in fats."
       A. Yes, I heard you read that, yes.

MR. MORRIS: So if it was known that your foods were high in
fats -- sorry. This is hard work.

MR. JUSTICE BELL: Just take stock for a moment. Mr. Green --
and I hope he will correct me if I am wrong -- is clearly
not aware of what is in the Surgeon General's Report. It
seems to me, therefore, that it is going to be largely
unproductive asking him what he makes of it, at least
insofar as he comes here as a representative of
McDonald's. Essentially, he is -- no disrespect to him --
       just another witness.

You may, at the end of the day, want to make some comment
about the fact that someone in his post in McDonald's is
unaware of the Secretary General's views, or what the
guidelines are, but, if you do choose to make comment along
those lines, that is comment and not, you may think, a
matter for cross-examination of the witness once that has
become clear. Do you follow what I am putting to you?

MR. MORRIS: Yes. (To the witness) When the Surgeon General
talks about over-consumption of certain dietary components,
and then says "chief among them is food high in fats",
marketing has an influence, does it not, on the food
       choices of the public?
       A. I think, certainly, marketing informs the public of
food choices that are available, and then the consumer-----

  Q. Marketing promotes certain foods, does it not?
       A. Yes. It promotes our menu, yes.

  Q. It promotes them as effectively as possible, does it not?
       A. We try to have effective marketing for our menu, yes.

  Q. On page (vii), the preface by the Assistant Secretary for
Health of the United States government, says, at the bottom
       of that page:

"Federal, State and local governments, the American
public, the food industry" -- which is what you are part
       of, yes, the food industry?
       A. Yes.
