Day 044 - 02 Nov 94 - Page 16

       A. I do not know of anything, to my knowledge, that might
be similar, because I am not really aware of the document
that you are talking about in the United Kingdom. I know
that in the development of our food and the ingredients in
the food there is constant care taken by those that develop
it within the context of making sure that the food is
       appropriate.

  Q. When you say "appropriate" do you mean healthy?
       A. Yes, they can fit into a healthy diet, yes.

  Q. A Mars Bar can fit into a healthy diet, can it not, or a
       packet of sweets?
       A. I imagine that it could as well, yes.

  Q. You said yesterday that your food was healthy. Are you
       sticking by that?
       A. Yes. I still believe that our food can be a good part
       of a healthy diet, yes.

MR. MORRIS: Would you say your food could be described as
       healthy?

MR. JUSTICE BELL: He started the answer with "yes", and then
went on to enlarge on it.

MR. MORRIS: Based upon that, you are confident that you are
promoting -- I am asking you in the context that you are
the largest food service marketer in the States; is that
       correct?
       A. I believe so, yes.

  Q. So you are confident that you are promoting healthy
       products?
       A. Yes. I am confident that our food is healthy food that
can fit into a healthy diet, yes. Just so I am clear, to
me "healthy", since I am not a nutritionist, in fact means
that it can be part of a healthy diet. I think the two of
them are, essentially, the same. I do not want to give you
an impression that I am an expert in this field, and I am
going pretty much on my opinions and the opinions that
I have read and the opinions that people have told me.

MR. MORRIS: Yes. But you are the representative in the court
today of a corporation which you claim is committed to
public health; you are specifically concerned with -- you
are representing the largest marketing company on these
       foods.

MR. JUSTICE BELL: I think you ought to be a bit careful about
that. A witness can speak as to his personal view or, if
he is employed by a large corporation, save in so far as he
chooses to limit his answer, he can speak on behalf of the
corporation in the field in which he works. It might not
be right to suggest that he can speak on behalf of the
corporation, in this case, in fields outside marketing,
however high his post is. If you are going to suggest that
he can speak for the company in fields outside marketing,
you should ask him whether he can, first of all, rather
       than just assume he can.
