3 that you are talking about in the United Kingdom. I know
4 that in the development of our food and the ingredients in
5 the food there is constant care taken by those that develop
6 it within the context of making sure that the food is
7 appropriate.

9 Q. When you say "appropriate" do you mean healthy?
10 A. Yes, they can fit into a healthy diet, yes.

12 Q. A Mars Bar can fit into a healthy diet, can it not, or a
13 packet of sweets?
14 A. I imagine that it could as well, yes.

16 Q. You said yesterday that your food was healthy. Are you
17 sticking by that?
18 A. Yes. I still believe that our food can be a good part
19 of a healthy diet, yes.

22 healthy?

25 went on to enlarge on it.

28 promoting -- I am asking you in the context that you are
29 the largest food service marketer in the States; is that
30 correct?
31 A. I believe so, yes.

33 Q. So you are confident that you are promoting healthy
34 products?
35 A. Yes. I am confident that our food is healthy food that
36 can fit into a healthy diet, yes. Just so I am clear, to
37 me "healthy", since I am not a nutritionist, in fact means
38 that it can be part of a healthy diet. I think the two of
39 them are, essentially, the same. I do not want to give you
40 an impression that I am an expert in this field, and I am
41 going pretty much on my opinions and the opinions that
42 I have read and the opinions that people have told me.

44 MR. MORRIS: Yes. But you are the representative in the court
45 today of a corporation which you claim is committed to
46 public health; you are specifically concerned with -- you
47 are representing the largest marketing company on these
48 foods.

50 MR. JUSTICE BELL: I think you ought to be a bit careful about
51 that. A witness can speak as to his personal view or, if
52 he is employed by a large corporation, save in so far as he
53 chooses to limit his answer, he can speak on behalf of the
54 corporation in the field in which he works. It might not
55 be right to suggest that he can speak on behalf of the
56 corporation, in this case, in fields outside marketing,
57 however high his post is. If you are going to suggest that
58 he can speak for the company in fields outside marketing,
59 you should ask him whether he can, first of all, rather
60 than just assume he can.
