     1   MS. STEEL:  Professor Crawford is actually not aware of that.

     4   MR. MORRIS:  No.  We did not actually realise that was what the
     5        position was.

     7   MR. JUSTICE BELL:  Can you tell him that, as he is your
     8        witness?

    10   MR. MORRIS:  As far as we could see, as our understanding was,
    11        it was our right to recall him but that we did not
    12        necessarily have to do that.

    16   MR. MORRIS:  For cross-examination.

    18   MR. JUSTICE BELL:  No.

    20   MR. MORRIS:  Re-examination.  Yes.  I understand what you are
    21        saying.

    23   MR. JUSTICE BELL:  You understand now what the basis of my
    24        decision is?  If you had said that you wanted to recall him
    25        for re-examination or further examination-in-chief, I would
    26        have agreed to that, subject to any argument from
    27        Mr. Rampton.  But a more important factor is the need for
    28        further cross-examination in the sense that I can consider
    29        that scientific papers which Mr. Rampton may want to
    30        comment on at the end of the day, which fall within the
    31        province of Professor Crawford's evidence, ought to be put
    32        to him, insofar as it is to argued that they are contrary
    33        to his evidence.

    35        Can you tell Professor Crawford that there will be a need
    36        for him to come back?  You can certainly tell him why.
    37        What I suggest you do is, if need be, you can show him a
    38        copy of the transcript of our discussion this morning about
    39        it and find the discussion on whatever afternoon it was
    40        that we dealt with it a few days ago.  If you cannot
    41        identify it, Mr. Atkinson may be able to tell you quite
    42        readily when that occurred.

    44        If you are in any two minds about it at all, unless
    45        Mr. Rampton objects, I suggest you ask Mr. Atkinson to
    46        explain his understanding of it.  But I think you do know
    47        now, anyway.

    50        day it was.  Is that most of the legal matters?

    55        not know if there are any transcripts available from
    56        yesterday?

    58   MR. RAMPTON:  My Lord, I did not get mine until this morning.
    59        The Rolls Royce service did not get to Mr. Morris and
    60        Ms. Steel in time.  It is coming later, I gather.
