Day 038 - 19 Oct 94 - Page 07

MS. STEEL: You have a copy of the schoolchildren one. We
still have not managed to get hold of the pregnant mothers
one. There is also another paper which we served on the
Plaintiffs last week. I am not sure whether you have had a
copy of that? That is the report he referred to.

MR. JUSTICE BELL: I want someone to make a note, and at some
stage I want you to say either: "We have got the expectant
mothers; here it is; put it with the schoolchildren" and
tell me where the schoolchildren are, or: "We have not
been able to get the expectant mothers paper" but remind me
where the schoolchildren are, so I can put that down as a
reference. If you do not remind me, when I come to
reconsider the matters I may overlook it.

MS. STEEL: The other paper was the one about: Are different
diets necessary for heart disease and cancer?

MR. JUSTICE BELL: I want you to tell me just where it is in due
       course.

MS. STEEL: Just on that subject, we may still want to recall
       him for re-examination.

MR. JUSTICE BELL: I suggest you reserve that until after we
have argued about possible amendment to the Statement of
Claim, not necessarily because if leave is given to amend
that will mean you want to ask Professor Crawford something
more, but something which crops up in argument may. So,
wait until you have heard that argument, heard my decision,
then we can come back to that, if necessary.

MS. STEEL: OK. There were three papers that were served last
week on the Plaintiffs; one of those was: Heart disease
and cancer, are different diets necessary? There were two
other ones which were new papers which Professor Crawford
gave to us, and I am not sure what to do about that.

MR. JUSTICE BELL: Come back to it all of a piece after the
argument about amendment. Are you going to call
       Dr. Millstone?

  MS. STEEL: Yes.

                     DR. ERIK MILLSTONE, Affirmed
                      Examined by the Defendants

MS. STEEL: Can you give your full name to the court, please?
       A. Yes, my name is Erik Paul Millstone.

  Q. Could you give your address as well?
       A. My address is the Science Policy Research Unit,
       University of Sussex, Brighton.

  Q. Is it right you are a doctor?
       A.  I do have a doctorate, but I am not a medical doctor;
       my doctorate is in philosophy.

  Q. Should we call you "Dr. Millstone"?
