Day 025 - 16 Sep 94 - Page 10

MR. JUSTICE BELL: The fact that you cannot talk to the witness
outside court does not mean to say that when you
re-examine you cannot ask the question you might have been
tempted to ask in the corridor to put them back on what
you say is the right track. But use re-examination for
that, not any discussion outside court. No-one is drawing
a sinister inference on this occasion; it is just so you
       understand.

MR. RAMPTON (To the witness): Mr. Gardner, you went to see a
play last night; did you have a meal?
       A. Yes.

  Q. You did?
       A. Yes.

  Q. What did you eat? What did you eat?
       A. Cheese and bread.

  Q. Yes, cheese and bread. Is that all?
       A. I think I had some candy -- I do not remember exactly.

  MR. JUSTICE BELL: Sweets?
       A. Yes.

MR. RAMPTON: Candy does not have much nutritional value, does
       it?
       A. I would say in the case of this none whatsoever.

  Q. We have to be moderate in the amount of candy that we eat,
do we not, Mr. Gardner, unless we should rot our teeth?
       A. We should be moderate in the candy we eat. The
studies are, in fact, right now a little mixed on what the
calorigenic teeth rotting qualities of processed sugar
       are.

  Q. We should also be moderate in the amount of sugar in the
form candy or in any other form we eat, lest our energy
consumption exceeds our energy expenditure and we become
fat; is that right? Is that the reason for moderation?
       A. I do not know the direct correlation between calorie
consumption in the form of sugar and weight gain, but it
is important to watch what you eat. Sugar is one of those
things I try to watch, and I do not think there is
evidence before the court, but I think a few could say
I do not watch it particularly well.

  Q. Cheese contains an amount of animal fat, does it not?
       A. I have no idea. I presume it does, but I do not know.

  Q. You do not know? Do you know it contains calcium?
       A. If it has milk it would have calcium, yes.

  Q. Can we agree cheese is generally made from milk?
       A. Yes.

  Q. If one ate too much cheese, one might get too much animal
fat, might one not? It is a dairy product, is it not?
       A. I would need to know what you mean by too much cheese,
Mr. Rampton, to answer that question properly.
