Day 025 - 16 Sep 94 - Page 07
Pleading.

MR. JUSTICE BELL: So it is in the Abstract?

MS. STEEL: Yes, it is; sorry.

MR. JUSTICE BELL: It does not matter as long as I am
straight. I was anxious, because I make it plain to
everyone I have been working off the Abstract rather than
dipping into the original bundle of pleadings. If there
is anything important which is not in the Abstract, then
I need to be told. I have assumed, Mr. Rampton -----

MR. RAMPTON: I have trusted Mr. Atkinson, who I regard as
wholly trustworthy.

MR. JUSTICE BELL: Absolutely. This is the first time a
question arose that something might not be in; as it
happens, it is in.

MR. MORRIS: We will have to check maybe at lunch time because
we have not looked at these in detail.

MR. JUSTICE BELL: You need not check at lunch time, just check
some time that everything that you would want to draw to
attention in relation to your case in the pleadings is
actually in the Abstract, because it is much easier for me
to work off that than the pleadings bundle, but there is
no urgency about it. Yes.

MS. STEEL: Looking at paragraph C on that page, the first
plaintiff is McDonald's Corporation; "that [McDonald's] do
not inform the public of all the facts when they claim
that the food they sell is nutritious. Particularly, that
the food they sell is high in contents such as fat which
can be linked to various diseases, especially heart
disease, and/or cancer". In your experience, in dealing
with McDonald's, which you have detailed in this court, do
you think that that is a true or accurate statement?
A. Yes.

MS. STEEL: Is there anything else? Otherwise we have
finished.

MR. JUSTICE BELL: Thank you.

Cross-Examined by MR. RAMPTON
