Day 021 - 29 Jul 94 - Page 05

     1 Yes, Mr. Morris?

2 MR. MORRIS: Just before I start cross-examination I have to
leave at 4 o'clock today, I am sure everyone will be
3 relieved if we finish by then. So we are going to attempt
              to finish by 3 o'clock.
     4
MR. JUSTICE BELL: Let us see how we do. We may take a shorter
5 break in the middle of the day if that will help you.

6 MR. MORRIS: We are a little all over the place because
Mr. Wheelock is a bit out of synch, so if there is
7 anything you could do that will help matters along in a
              constructive way -----
     8
MR. JUSTICE BELL: Very well, just do your best.
     9
MR. MORRIS (To the witness): Some preliminaries. I believe
10 the question came up about the turnover of your company
and we asked for your turnover. Is that correct? I have
11 not checked the transcript, but did you say something to
the effect that it can be checked from public sources?
    12 A. Yes.

13 Q. We did try to check from public sources, but there is no
information given at Companies House on the turnover of
14 your company, which I have the information here. Is that
correct, that you do not give the turnover?
15 A. I can assure you that the official requirements in
relation to the finances of my company are lodged in
    16 accordance with the law.

17 Q. I am not saying they are not. All I am saying is that the
official documents do not include turnover, which is no
18 longer a requirement for small companies. Is that a fact?
              A. I am sorry, I had not appreciated that.
    19
         Q. Does the court want to see the document?
    20
MR. JUSTICE BELL: No, I do not think so.
    21
MR. MORRIS: Can I, therefore, just ask you to say what the
22 turnover of the company is?

23 MR. RAMPTON: I object to that question. I do not see its
              relevance.
    24
MR. JUSTICE BELL: I do not think actual figures are relevant.
25 My attitude to the evidence of someone like Professor
Wheelock, when I sit down to evaluate it, will be to see
26 whether the extent to which it hangs together in the face
of any cross-examination you have made or challenge is.
27 I have very much in mind that his company receives a
substantial contribution by way, presumably, of fee income
28 from McDonald's. What I make of that in the future we
will have to see. I can tell you now, I cannot imagine
29 actual figures making any difference.

30 MR. MORRIS: If we move on to the grey book, if everyone can
get a copy of the grey book.
