Day 017 - 25 Jul 94 - Page 02

     1 25th July, 1994.

2 MR. RAMPTON: My Lord, before I call Dr. Arnott there are some
documents to be filed. Would your Lordship wish to do
3 that now or wait until the end of the day?

4 MR. JUSTICE BELL: I would rather put them in now, then I will
not tuck them away and not be able to find them.
     5
MR. RAMPTON: There are three; two go in volume 9 of the yellow
6 files, which is Rearing and Slaughter; tab 10 is
Dr. Gregory's report. At the back of Dr. Gregory's report
     7 there are two addenda.

     8 MR. JUSTICE BELL: Yes.

9 MR. RAMPTON: The first lot of the typewritten documents, which
is a report done by Bristol University in 1987, goes
10 behind the first of Dr. Gregory's addenda; the messy,
handwritten notes go behind the second addendum. They are
11 the notes about the chicken injuries.

12 MR. JUSTICE BELL: The second addendum is the one which deals
with the pathology of 25 birds.
    13
MR. RAMPTON: That is the one. Those are the research
    14 department's internal notes.

15 The other document is a document which Professor Keen did
not have. It is a report which he makes reference to
16 which has not yet been published. It should go in orange
4A at tab 24. It is an unpublished report of which the
17 author has now sent Professor Keen a copy.

18 MR. JUSTICE BELL: I had better hand that back. Have the
              defendants, in fact, seen it?
    19
MR. RAMPTON: I do not know; I do not really know where it came
    20 from.

21 MR. JUSTICE BELL: Perhaps it could be handed to Mr. Morris and
Ms. Steel. They can take the opportunity of reading it if
22 they wish. Obviously it is interesting to read, but
I will not take any of it as evidence unless it is spoken
    23 to by a witness.

24 MR. RAMPTON: Yes. Dr. Arnott, could you, please, go to the
              witness box?
    25
                                 Dr. Arnott, Affirmed
    26 Examined by Mr. Rampton

27 Q. Dr. Arnott, are your full names Sidney Arnott?
              A. Sidney John Arnott.
    28
         Q. Do you give as your address St. Bartholomew's Hospital in
    29 London?
              A. That is correct.
    30
         Q. Are you a consultant in radiotherapy and oncology at that
