Day 016 - 22 Jul 94 - Page 30

1 demonstrates, as I say, it is perfectly reasonable and
feasible to visit McDonald's once a week and still have a
2 total diet for the week which meets the dietary
              recommendations.
     3
         Q. It is possible to construct all sorts of things and you
4 are trying to, are you not, claim that McDonald's is
existing in the real world, yes?
     5 A. Yes.

6 Q. And you are satisfying demand, yes?
              A. Certainly.
     7
         Q. Well, McDonald's is?
8 A. There is a demand for the products that McDonald's
              produce and sell, yes.
     9
         Q. And there are chronic degenerative diseases such as heart
10 disease and cancer which are endemic in our society based
              on diet; is that correct?
11 A. No, I would not go along with you on that. What
I would say is that the death rate from heart disease in
12 this country is very high.

13 Q. But in your statement, does it not say on page 24, the
              first page of your statement?
14 A. Can I just refer to that, please?

15 MR. JUSTICE BELL: Yes, it is in tab 5.
              A. What page number?
    16
         MR. MORRIS: It is 24.
    17
         MR. JUSTICE BELL: Second paragraph.
    18
MR. MORRIS: The second sentence: "While it is now generally
19 accepted that diet does play an important role in the
development of the so-called degenerative diseases, which
20 include coronary heart disease and some cancers, the
precise role of the different components in the diet are
21 very difficult to elucidate". Then there are if's, but's
and maybe's, specifications, whatever. What you are
22 saying there is that a fact that diet plays an important
role in these degenerative diseases such as coronary heart
    23 disease and some cancers?
              A. Yes.
    24
         Q. Therefore, if McDonald's existed in the real world, does
25 it not have to recognise that the diet in our society --
that these people who die from cancer -- hundreds of
26 thousands who die from cancer and heart disease based upon
diet are eating a poor diet, are they not?
    27 A. No.

28 Q. I am not talking about the people in the chart -- would
you say that their diet is, as a nutritionist, poor
29 quality, is unhealthy for them?

30 MR. JUSTICE BELL: Let us distinguish them. If you had
hypocholesteremia it would not do you much good to eat one
