Day 016 - 22 Jul 94 - Page 09

1 Q. There are quite a lot of people who have an intake less
              than that?
2 A. Well, sure, but I mean the whole point about having
this is so that people can adjust their intake to what is
     3 actually recommended.

4 MS. STEEL: Perhaps I should address this to Mr. Justice
Bell: I do not think the plaintiffs should be allowed to
5 place reliance on this chart unless they supply the
figures behind it, otherwise we cannot begin to look at
6 it, to test to see whether it is accurate and reliable.

7 MR. JUSTICE BELL: I think that is a comment which you have to
make at the end of the day.
     8
MS. STEEL: Right. I bring this up because yesterday, you may
9 remember, we brought up the Peckham Fastfood Survey and
Mr. Rampton made a lot noise about us having to prove it.
10 I think they should have to prove this.

11 MR. JUSTICE BELL: I will have to see what, if any, weight is
attached to that chart. I have to say we have had more
12 specific evidence one way or the other.

13 MS. STEEL: I want to submit now that unless they provide the
information, it should not be allowed.
14 A. Well, perhaps if I could be helpful. We have provided
the detailed information for the UK.
    15
MR. JUSTICE BELL: Yes, I know you have.
16 A. The US would not apply to the UK; the UK would apply
              to the US.
    17
MS. STEEL: Not really, because the fat contents are
    18 different, are they not?

19 MR. RAMPTON: My Lord, I do have in my hand "McDonald's Food -
the Facts" for September 1990, which in the back, as for
20 the preceding three or four years, are set out the fat
calorie -- sorry, carbohydrate, protein, cholesterol,
21 sodium, vitamins, and so on, contents of every single item
on the menu. If Professor Wheelock could take it away
22 with him, he could certainly calculate the values for this
              chart.
    23
MR. JUSTICE BELL: He could do in so far as there were menu
    24 items.

    25 MR. RAMPTON: Yes.

26 MS. STEEL: He could not do it in terms of the other meals and
he also could not do it in terms of anything that has
27 changed since that booklet was published.

28 MR. JUSTICE BELL: I suppose he could look in his Bible in so
far as that may relate to US foods, but I have your point.
29 It is probably obvious, but what does the small "c" stand
              for?
    30
MS. STEEL: I think it is cups.
