Day 016 - 22 Jul 94 - Page 06
1 person had had a Big Mac, large portion of french fries
and a straight Coca Cola, if they do them in different
2 size cartons, the big one, then the calories would have
been 2,000 and the fat content would have been X and the
3 saturated fat content would have been Y and the sodium
content would have been Z", then that might pack rather
4 more punch. I am not suggesting it will, but do you see?
5 MR. MORRIS: Yes.
6 MR. JUSTICE BELL: That is why I think you should be wary of
just saying because you pick some fault with a table, that
7 means it will not carry any weight. Do you understand the
point I am trying to make to you?
8
MR. MORRIS: Yes.
9
MR. JUSTICE BELL: Maybe it will, maybe it will not, but if you
10 can come up with something positive against it, then that
may carry rather more weight.
11
MR. MORRIS: If I point out two other things about this US
12 table: The one per cent low fat milk (which both
candidates seem to be pretty keen on as a drink) was only
13 introduced in 1991, according to the Nutrition
Initiatives. It said it replaced two per cent milk with
14 one per cent low fat milk, which is double the fat level.
Secondly, the chips which, of course, are also an
15 essential part of McDonald's menu, if you see the second
point in the Nutrition Initiatives, they were brought in
16 in 1991 as 100 per cent vegetable oil; reducing the
saturated fat by nearly 50 per cent, according to that.
17 So, I would say -- I understand we should bring it up in
summary -- but I would say there is no need to go through
18 the whole ----
19 MR. JUSTICE BELL: Let us take what you have said in two
stages. You do not have to go through all these points
20 with the witness in cross-examination. When you come to
decide what comment you are going to make and how you have
21 to make it you have to decide for yourself whether you are
going to make it just on a criticism basis, it was two per
22 cent rather than one per cent, or something of that kind,
or you are going to develop that further and do some sums,
23 show what calorie difference and fat content and saturated
fat content difference that would make, do you
24 understand?
25 MR. MORRIS: Yes.
26 MR. JUSTICE BELL: It is entirely up to you, but one may carry
rather more weight than the other at the end of the day.
27
MR. RAMPTON: I have been thinking about what Ms. Steel has
28 just said. It is clear, to my mind, she may be labouring
under what may turn out to be an utterly fatal
29 misapprehension. If she were right, what would follow
from that is she has no need to say anything by way of
30 defence, so far as the American Corporation is concerned.
That would leave the defendants in this position: If your
