2 MR. RAMPTON: Yes, I agree. In fact, I thought there were
three full copies, one of which came from the solicitors'
3 offices. I do not feel that there is any apology to be
offered by me on behalf of Mrs. Brinley-Codd. I comment
4 that this kind of inefficiency cannot reasonably be
attributed to Mrs. Brinley-Codd. The defendants have
5 known since goodness knows how long that Professor
Wheelock will give evidence on this day.

They asked for Professor Keen's references; they did not
7 ask for Professor Wheelock's references. The references
have been in court since the beginning of the trial, but
8 if they have not looked at them I can only say they only
have themselves to blame. However, having said all that,
9 which is by way of defence, as it turns out, the only
document to which I shall be referring Professor Wheelock
10 to any great extent is this document, which is a
government document, which is quoted at length in his
11 report in any event and which the defendants have a copy
of. It is what one might call the authoritative work so
12 far as the government of this country is concerned on diet
and nutrition.

MS. STEEL: It is clear from the index ----

MR. RAMPTON: One would have thought the defendants'
15 nutritional experts would have provided the defendants
with a copy of it in any event..

MS. STEEL: It is clear from the index there was no mention of
17 any expert references for Verner Wheelock on this page.
Why we should be expected to know they existed, I do not
18 know.
19 MR. MORRIS: We want to take a constructive view of the
situation.

volume IV A on the index.

MR. JUSTICE BELL: If you look at 2, I have a white facing page
25 at the very front and No. 2 is the plaintiffs' expert
reference volumes I to IV. If you turn to tab 2, I have a
26 number of volumes.
27 MR. RAMPTON: I know. In a sense that exposes itself as being
an archaic document because it does not contain any
28 reference to Dr. Arnott or to Professor -----

30 MR. JUSTICE BELL: It has Dr. Arnott in IV. The point is I am
surprised that you have only just discovered this morning
