Incidentally, the news is that Oprah Winfrey has won the suit, after the judge said she wasn't subject to the "food libel" claim after all, but 'only' a common law 'business disparagement', which was harder for the opposition to prove. What this means as far as the rights of others are concerned, I still don't know.
