Actually, there WERE precedents for the Mabo and Wik cases - the decison was largely based on similiar cases heard regarding indigenous owership of settled land in Canada's Supreme Court. And besides that, the Aborigines and Torres Strait Islanders had a valid argument - the scamming of Mcdonald's is hardly just. It is just plain pathetic.
