Day 117 - 27 Apr 95 - Page 11

       A. That is correct, my Lord.

MR. RAMPTON: Does it follow, Mr. Nicholson, that if you did
your, say, 40 or 42 hours during the basic rate period,
that is to say, between 7.00 in the morning and 7.00 in the
evening, you would never get any extra breaks at all by
       this route?
       A. No, you would get whatever your current rate was.

  Q. You get paid for the hour but it would not go up because
you worked an additional two or three, or whatever it might
       be?
       A. No.

  Q. Are there payments in McDonald's for what one might call
       good performance?
       A. Yes, there are.

  Q. Who judges whether a crew member should be awarded a
       performance related increase?
       A. The Restaurant Manager.

  Q. At what stage in a McDonald's person's working life in the
Company does he first become entitled to a performance
       related increase?
       A. After 21 days.

  Q. Is it a rare thing that a crew member will get an increase
on his basic hourly rate, whatever it be?
       A. Common.

  Q. Common?
       A. Common.

  Q. Here we see on page 136 performance guidelines; 4 is
       outstanding, performance is always of exceptional quality;
3 is excellent, performance consistently exceeds job
requirements; 2 is good, performance meets job
requirements; 1 needs improvement, performance falls short
of meeting job requirements. 0, unsatisfactory,
       performance is unacceptable.

"Performance reviews in pay increases. It is McDonald's
policy to pay for the performance", and this is then
illustrated or explained: "Once you have successfully
completed your probationary period your manager, or one of
the assistant managers, will evaluate and review your job
performance. After this, once every four months one of the
management team will sit down with you and discuss your
       performance.

At this stage your performance and pay rate will be
reviewed in line with the table below. You will receive a
copy of your performance review. If your performance does
not meet the required standards or at the manager's
discretion an interim review may be conducted".

Again, a similar question to what I have asked many times
before: Does this actually happen on the ground?
       A. Every time.
