     1   MR. RAMPTON:  Your Lordship is right.  I did make an
     2        assumption.  (To the witness):  Do you know whether
     3        Dr. Juliet Gray did one or two of these leaflets?
     4        A.  Not specifically, no.

     6   Q.   When Professor Wheelock took -- I must not use that
     7        word -- when Professor Wheelock was appointed nutritional
     8        consultant to McDonald's, were you in charge of this aspect
     9        of the company's business, putting these leaflets out for
    10        the public to read?
    11        A.  No.

    13   Q.   You were not?
    14        A.  No.

    16   Q.   So, as far as you are concerned, has any of these kinds of
    17        leaflets gone out, as it were, without passing through a
    18        filter of outside information or criticism?
    19        A.  Certainly in the time I have been involved, no.

    21   Q.   While you have that one there in front of you, the one to
    22        which I have just drawn attention, "The facts about eating
    23        at McDonald's, Eating at McDonald's with nutrition in
    24        mind", can you tell us whether in February 1985 this
    25        leaflet would have been available to a member of the
    26        public?
    27        A.  Again I cannot be categoric, I think so, but I was not
    28        involved at that time.

    30   Q.   No, I know.  Just flip over the next tab, Mr. Oakley.  This
    31        is July 1985, six months later.  It is called "McDonald's
    32        Nutrition Guide"; it is a different document.
    33        A.  Yes.

    35   Q.   You see it contains advice or statements about variety,
    36        moderation and where McDonald's fits in.  Can I draw your
    37        attention to these words at the top of the column under:
    38        "Where does McDonald's fit in"?  Do you see those?
    39        A.  Yes.

    41   Q.   "Of course, we're not claiming that McDonald's provide
    42        every single nutrient you need for a healthy diet.  But it
    43        can certainly play a very valuable part".  Then there is
    44        more about that, and then it says:  "Naturally, to maintain
    45        a balanced diet you should plenty of cereals, fresh
    46        vegetables and fruit.  But McDonald's menu contains
    47        ingredients from all the food groups.  All good to eat as
    48        well as being good news if you want to stay healthy".  That
    49        is in July 1985?
    50        A.  Yes.

    52   Q.   I know you are not a nutritional expert, Mr. Oakley, but so 
    53        far as you are concerned, in 1994 when you do have a
    54        responsibility for leaflets of this kind in the stores, do
    55        you see anything there which, with hindsight, you would
    56        disagree with in the parts that I have just read out?
    57        A.  No.
