Day 044 - 02 Nov 94 - Page 37

Mr. Green whether he disagreed with any of Mr. Hawkes's
       answers.

MR. MORRIS: Yes. That might save time.

(To the witness) I might pick out one or two points
but, in general, would you back up what it says between
pages 149 to 155 of the Operations and Training Manual.
Sorry, that is the external number. The internal number is
       653 to 661.
       A. I have not read every line but, in general, I would say
that I agree with what it says, yes.

  Q. Was there anything that you recall that Mr. Hawkes said
       that you disagreed with?
       A. From what I remember him testifying to, I do not
believe I disagreed with what he said about this material.

  Q. Right.
       A. But I was not listening to every point, but I think you
       could make that.

  Q. Let me just have a quick look to see if there is anything
specific. I think you said yesterday the toys and premiums
in the States are free with Happy Meals?
       A. Yes. There is no what we would term up charge, meaning
there is no additional charge for the premium.

  Q. Right. On that page 149, under "Free Premiums" --
presumably, this is originally the US Operations and
Training Manual that is basically used worldwide,
       I presume?
       A. It is the basis of worldwide, and it looks like this is
the one that is used in the US, yes.

  Q. It is the one that has been used for the UK, as well, as
far as I can see. It has been disclosed for that purpose.
       It says here:

"....offering free premiums for children is one of the best
things you can do to make them loyal supporters of your
       restaurant."

       You would agree with that?
       A. Yes, I would.

  Q. On "McDonaldland Fun Times", in the bottom left-hand
corner, it says it is "the most widely circulated children
magazine in the world". Is that correct, so far as you
know? That is what it says.
       A. It may have been at the time, but Fun Times Magazine is
still in the restaurants, but it is not as often as it was
back when this Operations Manual came out. The target has
been changed just a bit, but it is still distributed in our
       restaurants on a periodic basis.

  Q. It says here "28 million copies per year", in the bottom
paragraph. When would that have been true?
       A. Probably the year before this manual was written.
